Current pricing and features are displayed within the App. We reserve the right to modify pricing and features at any time.
All payments are processed through Apple's App Store. By purchasing a subscription, you agree to Apple's terms and conditions. We do not directly collect or store your payment information.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period. Manage and cancel subscriptions through your Apple ID account settings.
Certain subscription plans may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price displayed at the time of sign-up.

You are responsible for maintaining the security of your account and for all activities under your account.

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE SHALL NOT BE LIABLE FOR ANY TRADING LOSSES, INVESTMENT LOSSES, OR OTHER FINANCIAL LOSSES YOU MAY INCUR, WHETHER OR NOT YOU USED INFORMATION FROM THE APP.
IN NO EVENT SHALL GOODWIN MEDIA LLC, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
You agree to indemnify and hold harmless Goodwin Media LLC from any claims, damages, losses, costs, and expenses arising from your use of the App, violation of these Terms, or your trading activities.
You may terminate your account at any time by deleting the App. We may suspend or terminate your access at any time, with or without cause. Upon termination, your right to use the App ceases. Data on your device remains until you delete it.
Before filing any legal action, you agree to attempt informal resolution by contacting legal@traderjrnl.com. We will attempt to resolve disputes within 30 days.
If informal resolution fails, disputes shall be resolved by binding arbitration under the American Arbitration Association rules in Salt Lake City, Utah.
YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION.
These Terms shall be governed by the laws of the State of Utah, United States. Legal actions not subject to arbitration shall be brought in state or federal courts in Utah County, Utah.
The following terms apply to the extent that the App is accessed through or downloaded from the Apple App Store:
You acknowledge that these Terms are concluded between you and Goodwin Media LLC only, and not with Apple Inc. ("Apple"). Goodwin Media LLC, not Apple, is solely responsible for JRNL and its content. These Terms may not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.
The license granted to you for JRNL is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that JRNL may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Goodwin Media LLC is solely responsible for providing any maintenance and support services with respect to JRNL. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to JRNL.
In the event of any failure of JRNL to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to JRNL, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the sole responsibility of Goodwin Media LLC.
You acknowledge that Goodwin Media LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to JRNL or your possession and/or use of JRNL, including but not limited to: (i) product liability claims; (ii) any claim that JRNL fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that JRNL or your possession and use of JRNL infringes that third party's intellectual property rights, Goodwin Media LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You agree to comply with all applicable third-party terms of agreement when using JRNL, including your wireless data service agreement and any other relevant service agreements.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
